Alex Aspinwall has been published in the latest edition of Family Law Journal with an article entitled “The place of criminal law concepts in family law proceedings: reasserting focus on the harm following Re T”.

Alex’s article examines the case-law surrounding treatment of criminal law concepts in family law proceedings. Alex uses the recent case of Re T (Appeal: Findings of Fact) [2024] EWHC 3327 (Fam) to frame discussion of the issue and highlights some common issues that arise in, particularly, Children Act proceedings with an overlapping criminal element. Alex provides suggestions for good practice in such cases within his conclusions.
