David Sharp and Christopher Miller of FOURTEEN have teamed up with James Dove of Harcourt Chambers to author “Orphans – are some of them prejudiced by the Children Act 1989? Can this be remedied” [2020] Fam Law 883 (first published in Family Law July 2020, reproduced with permission).
In this article, they explore a potential incompatibility between our law and the ECHR in so far as it relates to the acquisition of parental responsibility for orphans with no available family members to care for them. They suggest potential remedies that may be able to be put in place, pending urgent Parliamentary consideration of the issue.
