Clare Bishop represented the applicant Mother appealing HHJ Kushner’s order in a private children case. This was a difficult judgment as, in the words of the judge, the ‘parents are at daggers drawn’. A pragmatic approach was achieved through holding orders allowing for holiday contact for the Father and alternative Fridays to Tuesdays during term times. The judge also dealt with handover arrangements, given disagreements on where this should be. It was a successful appeal against HHJ Kushner’s order for a final order to be made at a DRA and so now the case will be remitted back for a final hearing where the parties would have the opportunity to provide witness statements.
